Entrants

Entry to the Promotion is open to Australian residents who are 18 years of age or over in all Eligible States/Territories who fulfil the Method of Entry requirements set out in this Schedule.

Method of Entry

To enter, an Entrant must, during the Promotion period:

GAME OF SKILL:

Using Entrant’s personal Instagram account, tag a mate who really needs some new gear under KingGee’s competition post, and tell the Promoter in 25 words or less, why that mate needs it, and also follow @kinggeeaustralia on Instagram.

The Promoter will select the best 5 comments as winners in accordance with the Promotion’s T&Cs and Conditions, and the prize will be awarded to the Entrant and the mate that they nominated.

Maximum number of entries

Entrants may enter the competition as many times as they like.

Notification of winners

Winners will be notified via the Instagram comments under the competition post and via direct message within 5 days of the respective draw.

The first name of the Entrant and their mate, their State(s) of residence and winning entry will be published on the Promoter’s social media channels.

 

 

 

T&Cs & Conditions of entry

1. Information posted online on how to enter, and identifying prize details form part of these T&Cs & Conditions (T&Cs).

2. The T&Cs must be read in conjunction with the Schedule which defines the terminology used in these T&Cs. 3. Where there is any inconsistency between these T&Cs and the Schedule, the Schedule prevails. 4. Participation in this Promotion is deemed acceptance of these T&Cs.

5. All entries become the property of the Promoter.

6. To the extent permitted by law, the Promoter reserves the right to withdraw or amend the Promotion and/or these T&Cs as it considers necessary during the Promotion, including but not limited due to circumstances outside its reasonable control and/or if required by a relevant regulatory authority.

7. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

9. By participating in this competition, each Entrant:

a. accepts these T&Cs without qualification or reservation;

b. warrants that their entry/comment is unique and original;

c. warrants that their entry/comment does not contain any material that is libelous, defamatory, obscene inappropriate or infringes any third party’s copyright or moral rights;

d. if nominating or referring another person as part of or in relation to the Promotion, warrants that they do so as that person’s agent, with authority to agree to these T&Cs on their behalf;

e. warrants that they enter the Promotion in their personal capacity and not in their capacity as an employee of any of the Promoter’s suppliers and/or customers.

Eligibility to enter Promotion

10. Entry is open only to Entrants who are natural persons over the age of 18 years old, currently residing in one of the Eligible States/Territories, and who satisfy the Method of Entry.

11. Entry is not open to:

a. directors, officers, and employees of the Promoter and/or prize suppliers (collectively the “Personnel”); or

b. the immediate families of the Personnel whether or not living in the same household as the Personnel.

12. Without limiting anything in these T&Cs, the Promoter has the right in its sole discretion:

a. to assess or verify the validity of entries and eligibility of Entrants;

b. to disqualify any Entrant who submits an entry and/or reject as invalid, any entry and/or prize claim that is fraudulent, misleading or deceptive, or not in accordance with these T&Cs of entry, or who manipulates or tampers with the entry process or is generally damaging to the goodwill or reputation of the Promotion and/or the Promoter.

13. The Promoter has no obligation to notify an Entrant if the Promoter deems their entry to be invalid.

14. The Promoter may but in no way is obliged to, contact an Entrant to obtain sufficient evidence of their eligibility to enter the Promotion and/or to claim a prize and, to the extent permitted by law, failure by the Entrant to provide such proof of identification or any dispute as to the identity or eligibility of an Entrant will immediately invalidate the Entrant’s entry and/or a prize winner's entitlement to a prize.

Promotion Period and Duration

15. The Promotion will be conducted during the Promotion period.

16. The time of entry will be deemed to be the time the entry is received by the Promoter, not at the time of transmission or attempted transmission.

17. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability (or that of a third party involved with the Promotion) to proceed with the Promotion on the dates and in the manner described in these T&Cs of entry, including but not limited to vandalism, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, pandemics or outbreaks of infectious diseases; the Promoter’s obligations in respect of the Promotion will be suspended for the duration of the event and/or the Promoter may in its absolute discretion, suspend, cancel or postpone the Promotion.

18. The Promoter may use various online and/or social media platforms to advertise or promote the Promotion including but not limited to Facebook, YouTube or Instagram. By entering the Promotion, Entrants accept that the Promoter is making no representaition that the Promotion is in any way sponsored, endorsed or administered by, or associated with such social media platforms. Any questions, comments or complaints regarding the Promotion should be directed to the Promoter and not to such social media platforms.

Method of Entry to Promotion

19. To enter the Promotion all Entrants must follow the Method of Entry set out in the Schedule during the Promotion period. Failure to do so will result in an invalid entry.

20. The Promoter may in its absolute discretion not accept a particular entry, may disqualify an entry, or cancel the entire Promotion at any time without giving reasons and without liability to any Entrants.

21. Entrants may submit up to the Maximum number of entries (if applicable) and in the absence of any published terms to the contrary, will be limited to one entry per Entrant.

22. The Promoter accepts no responsibility for any late, lost, delayed, incomplete, incorrectly submitted, corrupted, illegible or misdirected entries, claims or correspondence, including those entries not received by the Promoter for any reason and is not liable for any consequences of Entrant’s error including (without limitation) costs the Entrant or any third party may have incurred.

Winning

23. The Promotion is a game of skill, and chance plays no part whatsoever, in determining the winner.

24. The Promoter has the sole discretion:

a. to determine the validity of entries; and/or

b. to determine the prize winner(s).

25. All judging, decisions and actions of the Promoter and its staff will be exercised according to their absolute discretion after the end of the Promotion Period, and will not be open to the public.

26. The Promoter's decision and selection of the prizewinners based on their entries submitted is final and no correspondence will be entered into.

27. The winner(s) will be notified in accordance with the Notification of winners.

28. Notification to winners will be deemed to have occurred on the earlier of the time the winner receives actual notification from the Promoter or two business days after the notification is sent. The notification will include details about how the prize(s) can be claimed.

29. Each winner must confirm their acceptance of their prize as soon as is reasonably practicable, by any method specified by the Promoter and if none is specified, by email to the Promoter’s main contact email address available at www.workweargroup.com.au

30. Thereafter, the Promoter may publish the winner(s) name and state/territory of residence in accordance with these T&Cs and in particular, the Privacy section below.

31. In the event that a winner breaches these T&Cs of entry and/or fails to confirm their acceptance of the prize after notification in accordance with this section, the Promoter has the right to withdraw the initial winner’s prize offer, and conduct further fresh judging which will follow the same process as stated above until the prize package is accepted in accordance with these terms.

Prizes

32. Prizes are as-listed in the Schedule.

33. Where a prize is unavailable for any reason, the Promoter may substitute the prize for another item of equal or higher value.

34. No compensation will be payable if a winner is unable to use the prize as stated, for any reason.

35. Any prize is valued in Australian dollars unless expressly stated to the contrary.

36. Each Winner’s prize(s) will be dispatched to any regular Australian postal address (excluding PO BOX) and/or the nominated email address or instant messaging service provided by the Entrant at the time they submitted their entry.

37. Once Prize/s have been dispatched neither the Promoter, its related bodies corporate and/or sub-contractor nor the prize provider is liable for any voucher that has been stolen, forged, lost, delayed, damaged or tampered with in any way.

38. Entrants should seek independent financial advice prior to acceptance of their prize(s) in relation to any tax implications may arise from their acceptance of any prize awarded and the Promoter accepts no responsibility for any tax implications, fines or penalties that may arise from an Entrant accepting a prize.

39. Entrants are responsible for any and all expenses that they incur in entering the competition, and will not be reimbursed by the Promoter regardless of whether or not they win the competition.

40. Spending money, meals, travel taxes, travel insurance, passports, visas, transport to and from departure point and all other ancillary costs, as well as obtaining any of these, are the sole responsibility of the winner.

41. The Promoter has the right to withhold the provision of a prize where the Promoter is aware or reasonably suspects that the provision of the prize would, or may be, in breach of any conduct or compliance policy of the Promoter, its related bodies corporate, or any third party (including the Promoter’s customers) or any applicable laws. If the Promoter suspects fraud or misconduct, the prize may be withheld or withdrawn in the Promoter’s sole discretion.

42. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, subject to any written directions from a regulatory authority, and must be taken as awarded.

43. The Promoter accepts no responsibility for any variation in prize value (including between advertising of the Promotion and receipt of the prize).

44. It is a condition of accepting any prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

Prize Winner Employees of Promoter’s Customers and/or Suppliers

45. The Promoter respects the policies of its customers and/or suppliers which forbid the acceptance of awards, prizes or incentives by their employees in connection with their business, or which require the business to determine the terms on which such awards, prizes or incentives may be offered in connection with their business.

46. Accordingly and notwithstanding clause 9.e above, where the Promoter becomes aware that a winning Entrant is an employee of a customer organisation of the Promoter which has policies of the type described in paragraph 45 above in place, the Promoter may in its absolute discretion award the prize to the relevant customer organisation, instead of the individual Entrant.

47. In these circumstances, allocation of any prizes to any person within the customer or supplier organisation is to be determined by the relevant customer or supplier organisation that has been awarded the prize (or its relevant authorised officer).

48. Alternatively, the Promoter may require a prize winner to provide signed authorisation from an authorised officer of its employer confirming permission before the winner can accept the prize.

Intellectual Property

49. As a condition of entering into this Promotion, Entrants agree to assign all their rights in and to their entry and any related content to the Promoter, including any copyright or other intellectual property rights in the entry and related content.

50. Entrants warrant that entry content is original, lawful and not misleading and that the Promoter’s use of such content will not infringe the rights of any third parties.

51. The Promoter has no obligation to credit Entrant as the author of any content submitted and may otherwise do any acts or omissions which would otherwise constitute an infringement of any moral rights Entrant may have as an author of content.

Privacy and Usage of Personal Information

52. Subject only to these T&Cs & Conditions, each Entrant’s personal data, and that of any third party they nominate or refer in relation to a Promotion, is collected and held in accordance with the terms of the Promoter's privacy collection statement and privacy policy which can be found on its website at www.workweargroup.com.au/privacy-policy.

53. If an Entrant’s contact details change during the Promotion period, or those of any third party they nominate or refer in relation to a Promotion, it is the Entrant's responsibility to notify the Promoter in writing.

54. A request to modify any entry information including but not limited to a change in the Entrant’s contact details, should be directed to Promoter in writing.

55. The Promoter collects information about the Entrant:

a. to conduct the Promotion;

b. where appropriate, to award prize;

c. to assist in improving its goods and services; and/or

d. to contact Entrant in the future with special offers; and/or

e. for business, marketing and related purposes.

56. By entering this Promotion, each Entrant agrees that the Promoter may use, publish, or cause to be publicly published, any winning Entrant’s personal information, and that of any third party they nominate or refer in relation to a Promotion, on its website and/or other social media channels (including but not limited to Facebook, YouTube, LinkedIn, Instagram, Google):

a. for any of the purposes outlined in paragraph 55 above;

b. and share such personal information with its Australian Related Bodies Corporate;

c. if required by law; and/or

d. if not expressly prohibited by law.

57. In consideration for awarding the prize to the winner, any winning Entrant’s acceptance of the prize constitutes agreement by the winner to allow the use of the winner's name, state, image and/or likeness by the Promoter for editorial, advertising, promotional, marketing and/or other purposes, without further compensation.

58. To request access to the personal information that the Promoter holds on Entrant or any third party they nominate or refer in relation to a Promotion, to remove the Entrant’s information from the Promoter's records (or that of any third party they nominate or refer in relation to a Promotion), please write to the Privacy Officer at Level 1, 187 Todd Road, Port Melbourne, VIC, 3207, with Entrant’s and/or third party’s name and address.

Liability

59. To the greatest extent permitted by law, the Promoter excludes all warranties, representations or guarantees (Warranties) regarding the Promotion and any prizes, including any Warranties which may have been made in the course of advertising or promoting the Promotion.

60. The Promoter may engage third parties to conduct the Promotion and/or supply prizes, and the Promoter makes no Warranties and disclaims all liability in connection with any such third parties, their acts or omissions.

61. By entering the Promotion, each Entrant releases and indemnifies the Promoter and its Related Bodies Corporate (including its Personnel) from and against all actions, penalties, liabilities, claims or demands:

a. the Entrant may have and/or allege against the Promoter;

b. the Promoter may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an Entrant entering or participating in the Promotion, or winning or failing to win a prize, or using or permitting any other person to use the prize; and/or

c. where the Entrant nominates or otherwise refers any third party when entering the Promotion (whether in breach of clause 9.d above or otherwise), any actions, penalties, liabilities, claims or demands against the Promoter by that third party;

except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable.

62. If despite the foregoing clause, if the Promoter incurs (or may incur) a liability to an Entrant under any law which implies a term or condition into these T&Cs which cannot legally be excluded, the Promoter’s liability in respect of the Promotion is limited to the lesser of:

a. A single instance of the cost (if any) the Entrant incurred to enter the Promotion;

b. The cost of resupplying such goods or services as form part of the Promotion; or

c. AUD$100.

63. Without limiting any of the foregoing, in no circumstances will an Entrant or the Promoter have any liability to the other for any loss or damage suffered which is indirect or consequential in nature, including but not limited to loss of profit, loss of reputation, loss of goodwill, or loss of business opportunity.

Applicable Law

64. The Promotion and these T&Cs of entry will be governed by the law of the State of Victoria, Australia. Entrants accept the non-exclusive jurisdiction of courts and tribunals of that State or Territory in connection with any disputes concerning the Promotion.
